For the fourth year in a row, RA Administrative Court has been hearing the lawsuit filed by Gndevaz village residents, Vayots Dzor Region against state bodies. The next court hearing based on the lawsuit by nine Gndevaz residents is scheduled to take place this year, on December 5, 2012, at 11:00 am, in the Administrative Court of the Republic of Armenia. The respondents of this case are the Ministries of Nature Protection (currently Environment Ministry), Ministry of Energy and Natural Resources (currently the Territorial Administration and Infrastructure) and Lake Sevan Expert Committee on Expertise.
The residents of Gndevaz are demanding from the court to annul the permits issued by the authorities to Amulsar gold-bearing quartzite mining project. The plaintiffs have issued a statement in this case, which says: “The government has actually taken decisions that violate the interests and rights of RA citizens, as well as completely violate environmental legislation.
This case disputes the "expert" approval given by the Ministries of Energy and Environment of the Republic of Armenia. The positive opinion on the EIA issued by the Ministry of Nature Protection is also disputed, where Law on Lake Sevan and Law on Plants and Animals in the Red Book have been completely ignored and violated.
These two articles at least violate the prohibition of any mining activity in the Sevan catchment area, as well as deteriorate the habitat of red-listed plants and animals.
At a recent court hearing, it was decided that Lydian Armenia expert Dr. Raikin would submit an expert opinion to court. The plaintiff gave the opinion of the experts represented by him."
