Another Eminent Domain In Favour of “A&M Rare” LLC

On December 8, the Armenian Government made a decision to give 147.51 ha land area from Meghradzor Forestry Enterprise, a branch of “Hrazdan Forestry Enterprise” included in the administrative territory of Artavazd Village, Kotayk Region, for gratuitous use for indefinite term to “A&M Rare” LLC.

The Government’s propitious attitude towards this company is not limited with this action only, as on 25 February 2010 has already recognized eminent domain of 95.87549 ha of land area for farmland of Artavazd Village and gave these land areas to very “A&M Rare” LLC for producing freshwater and mineral water and constructing a bottling factory.  

“EcoLur” has already informed that Nature Protection Ministry had rejected Agriculture Ministry on allotting forestland areas for gratuitous use to ‘A & M Rare’ Company. 

‘This project is considered as unacceptable,’ says the reply letter. As substantiation, the Ministry lays down 32 and 33 Articles of Forest Code of Armenia. Forestlands mentioned above are also included in specially protected territories of Arzakyan and Meghradzor. The gratuitous use of these territories is not laid down,” the letter says.

A number of Artavazd villagers are refusing to give their land areas to the company, and in this regard legal actions have been filed. On 5 October 2011 Artavazd villagers also addressed a letter to the Armenian President. 

“As a matter of fact, about 80% of the village land reserve will be given to the acquirer, while the villagers won’t even be able to deal with cattle breeding, as there is just no free land area...This imaginary company, which was recognized as an acquirer, was founded on 25.02.2010, which is proved by the articles of association, i.e. on the very day they made a claim for obtaining 1300 ha of land area. What was most surprising is that the Armenian Government managed to examine this claim rather resembling a note and to reach a decision the same day.”
