The case of 'Lydian Armenia' CJSC vs RA Environmental and Mining Inspection Body proceeded into the stage of proceedings from the stage of the preliminary investigation. The ruling was reached by Judge of Administrative Court Argishti Ghazaryan at the preliminary court hearing held on 18 March. Out of the parties, the barrister of 'Lydian Armenia' CJSC Sayad Badalyan was present at the hearing while the representative of RA Environmental and Mining Inspection Body was absent.
It should be mentioned that the author of Amulsar project, 'Lydian Armenia' CJSC filed a claim on 23 November 2018 to RA Administrative Court against RA Environmental and Mining Inspection Body demanding to annul its decision no. 30-A dated on 27.08.2018 on obligating the company to refrain from performing certain activities.
The Inspection Body detected Apollon butterfly in the area of Amulsar mine, which is red-listed in Armenia, as well as red-listed Acantholimon caryophyllaceum Boiss. Based on the newly emerged ecological factors, the Inspection Body proposed to Nature Protection Ministry to recognize the state EIA statement issued to the project as invalid. In its turn, the ministry carried out its own investigation and didn't detect the habitats of the mentioned species in the mine area.
'Lydian Armenia' CJSC barrister Sayad Badalyan cited the conclusion of the Nature Protection Ministry as one of the grounds of the claim.
Judge Argishti Ghazaryan informed that the parties will be informed about the date of the next court hearing.
