New Legislative Requirements Towards Metallic Soil Users and Environmental Fees

On May 5, RA National Assembly discussed the draft law "On Making Amendments and Supplements to RA Law on Targeted Use of Environmental Taxes Paid by Companies." The draft law proposes to make deductions from the environmental fees paid by all metals mining companies, which will be directed to the implementation of environmental projects in the affected communities. According to the draft law, only 5 out of 26 metal ore mining companies currently are being deduced on environmental taxes.

According to the draft law, the calculation of the amount of the deductions by communities or settlements will be carried out by the authorized body in the Environment in the procedure prescribed by the Government of the Republic of Armenia.

According to Lilia Shushanyan, one of the changes is aimed at restoring local democracy. "Since the money is provided for subventional target programs, we suggest that community leaders publish the project in advance on the websites of their community hall or regional administration and then submit reports in the prescribed format."

According to the draft law, in addition to all companies licensed to extract metallic minerals, it will also cover the environmental taxes paid by "Armenian Copper Program", "Ararat Cement", "Mika-Cement", "Hrazdan TPP", "Yerevan TPP", "Gajegorts", "Armenian Nuclear Power Plant", "Nairit" Plant and "Gaj" CJSC, "Armenian Molybdenum Production" LLC, "Pure Iron", "Aske-Group" and Charentsavan-based "Dzulakentron" OJSC.
