Ombudsman: NGO Justice Accessability Right Needs To Be Guaranteed and Extrajudicial Body for Protection of Environmental Law Should Be Established

It is necessary to legally guarantee the right of access to justice for non-governmental organizations, to establish an extrajudicial body for the protection of environmental rights, and to set longer notice periods for public hearings.
 
These requirements are presented in the 2019 annual report of the RA Human Rights Defender. The report emphasizes that there are some discrepancies between the Aarhus Convention and the RA Law on Environmental Impact Assessment and Expertise in terms of public notice.
 
The Aarhus Convention Compliance Committee has considered Law on Non-Governmental Organizations as concerning, which provides for participation in public hearings as a precondition for filing a lawsuit or lack of opportunity to participate in public hearings.
 
The Human Rights Defender stated that it is necessary to take steps to establish an impartial independent extrajudicial body envisaged by the Aarhus Convention.
