Court Fight of Vayots Dzor Regional Municipality against Jermuk and Yeghegnadzor Aldermen's Councils To Continue in Administrative Appeal Court

The Administrative Court of Appeals accepted into proceedings Vayots Dzor Regional Municipality's appeal against RA Administrative Court's decision rejecting Vayots Dzor Regional Municipality's appeal against the Council of Aldermen in Jermuk and Yeghegnadzor.

Vayots Dzor Regional Municipality was demanding to annul Jermuk Aldermen's Council’s decision No. 88 dated on 18.12.2018 on Making Jermuk Community an Eco-Economic Area and Prohibiting Metal Mining in the Community and Yeghegnadzor Community Aldermen's Council’s decision No. 45 On Making Yeghegnadzor Community Eco-Economic Area and Prohibiting Metal Mining in the Community.

In both cases, the court found that the challenged legal acts were not of normative nature, the given legal act doesn’t contain legal norms, while the claimant has selected improper procedural way of calling upon to court.

It should be reminded that petitions addressed to the councils with the signatures of 3,000 Jermuk residents, 2868 Areni residents, 2,500 Yeghegnadzor residents and 2152 Gladzor inhabitants of on the prohibition of metal mining in their communities served as a basis for such decisions.
