REGISTER-TOOL OF VIOLATIONS OF “GREEN” RIGHTS
From the moment of their birth people have “green” rights, without which life is impossible. A person has a right to access clean water, clean air, i.e. right to live in a favorable environment, where s/he can live without any damage to health and their own business.
Rights to human health, safety and balanced environment are natural human rights and are prerequisites for the performance of other rights. People should protect their green rights for the sake of their own safety.
“EcoLur” Informational NGO has developed a tool for the protection of “green” rights - a register of the violations of “green” rights.
The register collects the violations of “green” rights having occurred because of decision-making of state authorities and business activities, the legislation protecting these rights and bodies in charge. This register makes visible the following items: the violations of fundamental human rights because of certain activities, bodies in charge and legislation violations made by them. This tool intends to raise the awareness of people on their fundamental rights, legislation protecting these rights, liability of decision-making state and local government bodies, liability of business entities, as well as it aims to promote people’s participation in the protection of their own rights.
As “green rights” don’t have a legal definition, those provision of national legislation and international conventions have been selected for each violation, which are also infringed in case of violation of “green” rights and which have legal power in the protection of these rights. We present the main violations of those “green” rights, which have a reference to the violation of legislation:
- Right to health,
- Right to have a healthy environment,
- Right to access water,
- Right to fair distribution of natural resources,
- Right to be informed and take part in decision-making,
- Right to protect their own rights,
- Right to select their own activities,
- Right to property and land area having the status of eminent domain recognized in line with RA Law “Alienation of Property for Public and State Needs”
Certain people should be liable for the violation of each green right, who have polluted or deprived people of their water, eradicated their land areas, haven’t informed about risks for health and limited their opportunities for socio-economic development. The register mentions bodies and departments in charge of each violation.
It’s important to know how people protect their green rights. For certain cases, you can find exact actions taken for the protection of the rights, which are recorded in the register, and use them in your own initiatives.
