Preliminary Examination of 5 Accused with Criminal Case on "Dzorahek" CJSC Property Alienation Abuse Finished
During the preliminary investigation of the criminal case initiated on the fact of abuse of official powers in the process of alienation of "DzoraHEK" CJSC property, sufficient evidence was obtained that a draft secret resolution of RA Government developed by RA Ministry of Defense in 2010 proposed to approve the alienation of the company's property in the amount of 3,600,000,000 AMD to "Dzoraget Hydro" LLC without complying to a number of statutory requirements, the Ministry of Defense of the Republic of Armenia, as the body exercising the authority to manage the state-owned share package of "Dzora HPP" CJSC.
As a result, the entire property with a market value of 4,646,400,000 AMD subject to mandatory valuation was sold to "Dzoraget Hydro" LLC for less than the actual value of 1,046,400,000 AMD without proper assessment of the market value.
In the criminal case, it was found out that after the alienation of "DzoraHEK" CJSC property, because of the actions of Robert Nazaryan, who held the position of RA Public Services Regulatory Committee, his deputy Nikolay Grigoryan, Shiraz Kirakosyan and Mushegh Koshetsyan, Committee members, instead of the tariffs to be set for the sale of delivered electricity produced by Dzoraget Hydro LLC in 2012-2019, tariffs for the same periods were unjustifiably set double, as a result of which Dzoraget Hydro LLC received a particularly large amount of 7,052,065,099 AMD from the natural and legal entities having consumed energy in Armenia.
Seyran Ohanyan was charged with committing the above-mentioned acts under Article 179 (3(1)) of RA Criminal Code, and Robert Nazaryan, Nikolay Grigoryan, Shiraz Kirakosyan, and Mushegh Koshetsyan with Article 308 (2) of RA Criminal Code.
The preliminary investigation on the separated part of the mentioned 5 defendants from the criminal case is over, whereas the case was handed over to the supervising prosecutor with the motion to approve the indictment and to send it to the court, as Special Investigation Service informs.
