“The Minister’s actions don’t constituent element of offence and there are no grounds for the initiation of a criminal case,” says A. Badalyan’s letter, Senior Prosecutor of Department for Defense of State Interests of Public Prosecutor’s Office. This letter is addressed to Anna Shahnazaryan, who, on behalf of “Teghout Support”, “Trchkan”, “Khosrov Reserve”, “Jermuk Won’t Become a Mine” civic initiatives, filed the statement of initiating a criminal case against Nature Protection Minister Aram Harutyunyan and other employees of the ministry for inactions and abuses in environment. The statement lays down certain examples, to which Prosecutor Badalyan particularly answered,
1. In regard with the poaching in “Khosrov Forest” State Reserve: “...the reserve director was dismissed, Head of garni section was dismissed, while employees in charge received administrative disciplinary actions...”.
2. In regard with “Khachaghbyur-2” SHP: “...on the basis of newly detected circumstances the minister annulled the opinion of the environmental expertise issued to the construction project of “Khachaghbyur-2” SHP, while the construction works have been stopped…What about cut down trees, the Ministry took measures to reveal those guilty and to compensate damage…”
3. In regard with Amoulsar gold mine opencast development near Jermuk resort and the construction of a gold extracting plant in the drainage area of Lake Sevan: “...the project has been issued a positive opinion of the environmental expertise, as the approaches expressed by Scientific-Expert Committee on Lake Sevan Preservation had been accepted, as well as the opinions of the civic initiatives raised during public discussions… At present any permit for the construction plant hasn’t been issued, opencast development isn’t carried out, only geological prospecting is in progress…”
4. In regard with the abuses in Nubarashen graveyard of pesticides and actions o 'Nairishin' public company, the shares of which are owned by the Minister: “...the issue was discussed in Special investigation Department. The Minister’s actions don’t constituent element of offence and there are no grounds for the initiation of a criminal case.”
