The Human Rights Defender’s Office (Ombudsman’s Office) has published a report on the activities of Energy and Natural Resources Ministry for 2013, which particularly says,
Current field-specific drawbacks and problems:
· A number of violations in the soil management legislation have been recorded, for example, soil management without any licensing or breach of soil management agreement, which witnesses about Ministry’s improper control and non-performance of satisfactory preventative measures.
· Generation and transportation of hazardous substances and wastes are not regulated because of imperfect laws, which result in serious risks for public health and environment.
· Though riskiness assessment rules have been adopted, a number of complexities have been detected in energy stations because of their imperfections.
·Despite environmental issues concerning public, such as soil management, SHPP construction and exploitation, the Ministry has organized only one public discussion.
Proposals
· To exercise strict control over the adherence to soil management legislation norms, technical regulations and other legal acts.
· To draw up a proper draft law to fill the legislative gaps in the generation and transportation of hazardous substances and wastes, particularly through defining “mining wastes” and “tail emissions” notions.
· To formulate legislatively more precise requirements of technical standards for riskiness assessment.
· To regularly organize and hold public discussion on the debatable issues in the field.
