The afforestation works envisaged by "High Voltage Electric Networks" CJSC in the area of 1.6 hectares in "Vahagn" forestry in "ArmForest" SNCO have not been carried out. According to RA Prosecutor General's Office, this is a consequence of the non-fulfillment of official duties by the officials of "ArmForest" SNCO.
It turned out that on December 21, 2018, 11 forest land servitude contracts were signed between "ArmForest" SNCO and "HVEN" CJSC for a period of 1 year.
According to the mentioned agreements, "HVEN" CJSC was provided with a total area of 0.76295 ha of forest area in the territory of Tsaghkashat forestry, "Lalvar forestry", for the purpose of construction of access roads for the installation of pillars within the framework of "Replacement of overhead lines" program, for the purpose of conducting overhead power transmission lines and their further operation.
By the order of “HVEN” CJSC, a working project was drawn up on afforestation of the 1.6 hectare area provided in Vahagn forestry, according to which the cost of afforestation and fencing works was about 12,912,000 AMD, whereas Yeghegnut forestry did not submit any objections or remarks in this regard.
However, it turned out that as a result of non-fulfillment of official duties by the officials of "ArmForest" SNCO in 2018-2020, despite the requirements set by RA Government Decision No. 1045-N dated on August 30, 2007, the contracts with "HVEN" CJSC were signed based on the invalid state expert opinion on the Environmental Impact Assessment, which has expired, whereas the company has not been obliged to implement a afforestation program under the concluded contracts, there is no obligation set for the parties not to properly carry out the work envisaged by the program, as well as the obligation to stop the work in case of non-compliance with the requirements and conditions of the contract, to compensate the damage caused to the forests and forest lands due to forest use. As a result, afforestation works in the amount of 12,912,003 AMD were not carried out on a 1.6-hectare plot of land and damage to forests and forest lands as a result of forest use has not been compensated, causing serious consequences for the state through negligence.
Sufficient data were obtained by the officials of "ArmForest" SNCO to use their official position against the interests of the service or non-performance of official duties, negligently causing serious consequences in the State Interests Protection Department of RA Prosecutor General's Office. A criminal case has been initiated on the grounds of Article 308(2) of RA Criminal Code. The criminal case was sent to RA Investigative Committee with an assignment to conduct a preliminary investigation.
