By the decision of Administrative Appeal Court, the execution of the decree of the Minister of Territorial Administration and Infrastructure TAI) dated on July 31, 2020 No. 1033-A on termination of the soil management right of "Fortune Resources" LLC was suspended. TAI had terminated the right of soil management of "Fortune Resources" LLC, as the company had not carried out any mineral extraction at Hrazdan iron mine in Kotayk Region, Republic of Armenia.
The company had challenged the court decision in Administrative Court, which rejected the company's claim based on the fact that the performance of the impugned act could not lead to significant damage to the plaintiff, as there is no evidence of the disputed subsoil being provided to another business entity.
In the same motion, the company provided conflicting information. First, it mentioned why the mine was not developed, then the company mentioned about the development of the mine. It was also mentioned about the employees, while in the 2016-2019 reports submitted by "Fortune Resources" LLC within the framework of the Transparency Initiative of the Republic of Armenia, it is clear that the company had only one employee, it did not extract ore at all.
TAI has twice filed a complaint with RA Court of Cassation. The complaint was returned for the first time to correct the mistake and to resubmit it. In the TAI's appeal for the second time, Cassation Court refused to accept the arguments presented in the appeal as inadequate and well-founded.
It should be noted that Hrazdan iron mine is located in the heart of Hrazdan Town, Hrazdan resident are categorically against the development of this mine.
