“Regional Monitoring Institute” NGO has issued a claim to Administrative Court against Nature Protection Ministry, which says, “On 23 October “Regional Monitoring Institute” NGO has filed a claim to Administrative Court against the Nature Protection Ministry (third parties – Kapan Municipality and “Dundee Precious Metals Kapan” CJSC) to annul the public discussions on reinforcing the dam of Geghanush tailing dump.”
The normative grounds of the claim are the justifications of violations of procedure standards. According to the plaintiff, the violations of the procedure laid down by the law resulted in the violation of the rights of the representatives of the affected communities and interested public (including NGOs) to information access and public participation in decision-making on environmental matters defined by the Armenian Constitution, international and domestic legislation.
