EcoLur’s Response to Lydian Armenia’s Legal Consultant Sayad Badalyan’s Statement

Sayad Badalyan, Legal Advisor of Lydian Armenia CJSC, clarified the ruling reached by Appeal Court in the Amulsar case, in particular, referring to EcoLur's publication on the court case.

The explanation says: "On July 9, 2021, EcoLur Informational NGO disseminated information that e RA Administrative Court of Appeal upheld the appeal in the Amulsar case filed by 19 residents of Gndevaz settlement, Jermuk town, Vayots Dzor Region, RA. The information was spread in the light that the court allegedly considered the claim of the plaintiffs to declare the Amulsar EIA conclusion invalid as substantiated. Meanwhile, the reality is different.”

In response, it should be noted that the EcoLur article only states that RA Administrative Court of Appeal, by its ruling dated on 09.07.2021, fully upheld the appeal in Amulsar case filed by 19 residents of Gndevaz settlement, Jermuk town, Vayots Dzor Region, represented by lawyer Nazeli Vardanyan, which corresponds to the ruling of RA Administrative Court No. VD/10166/05/18 dated on 09.07.2021, which says:

“4.1 To uphold the appeal filed by Nazeli Vardanyan, the representative of the defendants in this case;

4.1.1 Completely overturn the ruling reached by RA Administrative Court on 14.11.2019 on administrative case No. VD/10166/05/18 by sending this administrative case to RA Administrative Court for thorough examination.

4.2 To address the issue of distribution of costs in RA administrative and Administrative Appeal Courts as a result of a new examination of the case.

 4.3 This decision enters into legal force in one month after its publication. It can be appealed to the RA Court of Cassation within the same period՞.
