By the decision of RA Administrative Court, "Molybdenum World" LLC continues to be the holder of the soil management right of Dastakert copper-molybdenum mine. RA Administrative Court partially upheld the company's lawsuit against RA Ministry of Territorial Administration and Infrastructure (TAI) decree No. 1008-A dated on 28.07.2020, which terminated the company's soil management right.
The RA Administrative Court upheld the company's request to invalidate the TKEN order, but rejected the company's request to declare the order null and void.
It should be reminded that the main reason for the cessation of soil management right by TAI decree No. 1008-A dated on July 28, 2020 was the non-development of the mine by "Molybdenum World" LLC.
TAI appealed to RA Court of Appeals against the ruling of RA Administrative Court, but by the decision of August 6, 2021, RA Court of Appeals returned the appeal on the grounds that it did not comply with Article 134 (1(6)) of RA Administrative Procedure Code.
After winning the lawsuit, "Molybdenum World" LLC filed a new lawsuit in RA Administrative Court against TAI, demanding that the latter oblige to correct the mistake of the permit No. SHAT-29/174 and issue an order setting its term of 12 years instead of 9.2 years. Under the ruling of the court dated 03.01.2022, the lawsuit of the company was accepted for proceedings.
